Beta User Agreement

Effective date: October 8, 2026 · Version 2026-10-08

This Beta User Agreement ("Agreement") governs your participation in the beta release of MyMobileMenu (the "Service"). In this Agreement, "MyMobileMenu," "we," "us," and "our" refer to MyMobileMenu LLC, an Illinois limited liability company that operates the Service, and "you" and "your" refer to the person or entity using the beta. This Agreement supplements, and is in addition to, our Terms of Service and Privacy Policy. To the extent anything in this Agreement conflicts with those documents regarding the beta, this Agreement controls for the beta period. By checking the acknowledgment box when you create your account, you confirm that you have read and agree to this Agreement.

1. The beta is a pre-release service

MyMobileMenu is currently offered as a pre-release (beta) service so that restaurants and bars can use it and help us improve it. Because the Service is still in active development, features may be added, changed, or removed at any time, and the beta may behave differently than a final, generally available product.

2. Plans and pricing during the beta

Beta Plan accounts. Accounts shown as being on the Beta plan (accounts that joined while new accounts were placed on the free beta) receive every feature at no charge for as long as their account remains on the Beta plan. A Beta Plan account is never charged unless it affirmatively chooses a paid plan.

New accounts. New accounts choose a plan when they sign up: the Free plan, or a paid plan (Pro or Enterprise). No payment method is required to create an account or to choose a plan. A paid plan's features are available while you build your menus, and you are not charged until you publish your first menu on a paid plan; at that point you set up payment, monthly or yearly, before the menu goes live. Paid plans are governed by Section 4 (Subscription plans & billing) of our Terms of Service.

3. Scheduled end of the Beta plan

The free Beta plan is currently scheduled to end on January 1, 2027, or on a later date we announce. A Beta Plan account stays on the Beta plan until we end it; it does not change automatically on that date. Before a Beta Plan account that has not chosen a paid plan moves to the Free plan, we will email the address on the account. Moving to the Free plan never results in a charge.

4. Discontinuation & 60-day notice

We may discontinue, suspend, or materially change the Service or the free beta at any time, including before January 1, 2027. If we decide to discontinue the free beta or the Service before January 1, 2027, we will provide you with at least sixty (60) days' advance notice before the discontinuation takes effect. We will give that notice by a reasonable method, which may include email to the address associated with your account and/or a notice within the Service. Routine maintenance, temporary outages, bug fixes, and individual feature changes are part of normal beta operation and are not, by themselves, a discontinuation requiring this notice.

5. Your data & exporting your menus

You can export your menu data at any time using the export tools available in the editor. During any discontinuation notice period described in Section 4, you will continue to have access to those export tools so that you can save your menus. After the Service or the free beta is discontinued, your published menu URLs and QR codes may stop functioning, and your data may be deleted in accordance with our Privacy Policy. We recommend keeping your own copy of any menu content that is important to you.

6. "As is" — no warranties during the beta

To the fullest extent permitted by law, the beta is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind. Pre-release software may contain bugs, may change without notice, and may experience downtime or data loss. The disclaimers of warranty and the limitations of liability in our Terms of Service apply to your use of the beta. Because the beta is provided free of charge, our liability to you in connection with the beta is limited to the greatest extent permitted by law.

7. Feedback

We welcome your feedback about the beta. If you choose to share feedback, suggestions, or ideas with us, you grant us the right to use that feedback to operate and improve the Service without any obligation or compensation to you. You are not required to provide feedback to use the beta.

8. Changes to this Agreement

We may update this Agreement from time to time. When we make changes, we will update the effective date and version shown above. If you continue to use the Service after an update takes effect, you accept the updated Agreement. If you do not agree to an update, you should stop using the Service.

9. Acknowledgment

By checking the "I acknowledge the Beta User Agreement" box when you create your account, you confirm that you have read, understood, and agree to this Agreement — including that the Service is a free beta that is scheduled to end on January 1, 2027 and that may be discontinued earlier with at least 60 days' notice.
